1. About these Terms

These Terms & Conditions govern your use of Claressence.

By creating an account or using Claressence, you confirm that you have read, understood and agree to these Terms.

If you do not agree with these Terms, you should not create an account or use the service.

2. What Claressence is

Claressence is an AI-powered reflection companion designed to provide a private place to think, reflect and gain clarity of thought.

The service may remember relevant information from previous conversations and may generate reflections, summaries and insights based on your interactions.

3. Age requirement

Claressence is only available to people aged 18 or over.

By creating an account or using the service, you confirm that you are at least 18 years of age.

4. Early access and service development

Claressence is an evolving service and we may continue to develop, test and improve its features over time.

Features may change, become unavailable, be modified or be removed as the service develops. The service may also occasionally experience errors or interruptions.

We do not guarantee that the service will always be available or operate without errors.

5. Your account

You are responsible for keeping your account credentials secure and for activity carried out through your account.

You should not share your password with another person or allow another person to use your account.

You must provide an email address that you are authorised to use.

6. Your conversations and information

You retain responsibility for the information that you choose to provide to Claressence.

You should consider carefully what information you choose to enter into the service.

You should not provide information that you do not have the right to disclose or use.

Because Claressence is designed as a private space for reflection, you may choose to share personal or sensitive information in your conversations.

Claressence may process information you choose to provide in order to generate responses, reflections, memories and insights. Information about how we process personal information, including special category information, is provided in our Privacy Notice.

7. AI-generated responses

Claressence uses artificial intelligence to generate responses, reflections, summaries and insights.

AI-generated information may be incomplete, inaccurate, inappropriate or misleading.

You should use your own judgement when considering any information provided by Claressence.

Claressence does not guarantee that any AI-generated response is accurate, complete or suitable for your particular circumstances.

8. Not professional advice

Claressence is not a doctor, psychologist, psychotherapist, counsellor, solicitor, financial adviser or other regulated professional.

The service does not provide medical, psychological, therapeutic, legal, financial or other professional advice.

You should seek appropriate professional advice where necessary.

9. Crisis and emergency situations

Claressence is not an emergency or crisis service.

You should not rely on Claressence for immediate assistance in an emergency or crisis.

If you believe that you or another person is in immediate danger, contact the appropriate emergency or crisis service.

10. Free access and subscriptions

Claressence may provide a level of access without a paid subscription. Usage limits or other restrictions may apply to free access.

A paid subscription is currently available for £9.99 per month.

A subscription provides access to the features and usage allowances described at the time you subscribe.

Unless cancelled, your subscription will continue on a monthly basis and the applicable subscription charge will be taken automatically using your selected payment method.

The price, billing frequency and other important subscription information will be displayed before you complete your purchase.

11. Payments

Subscription payments are processed using Stripe. Claressence does not directly store your full payment card details.

By purchasing a subscription, you authorise the applicable recurring subscription payments to be charged using the payment method you provide.

Your subscription may be affected if a payment cannot be successfully processed. We may ask you to update your payment information or may restrict paid access until payment is successfully completed.

12. Cancelling a subscription

You may cancel your subscription at any time.

Cancellation stops future recurring subscription charges. Unless otherwise stated when you cancel, you may continue to use your paid subscription until the end of the period for which you have already paid.

Cancelling a paid subscription does not by itself delete your Claressence account, conversations, memories or other stored information.

If you also want your account and associated personal information deleted, you may request this separately in accordance with our Privacy Notice.

13. Consumer cancellation and refund rights

Nothing in these Terms affects any cancellation, refund or other rights that you have under applicable consumer law.

Depending on the circumstances, you may have a statutory right to cancel a contract entered into online within a specified cooling-off period.

Where you ask for a service to begin during a statutory cancellation period, the effect of cancellation and any amount payable or refundable will be determined in accordance with applicable law.

14. Changes to subscription pricing

We may change the price of a Claressence subscription in the future.

Any change affecting an existing subscription will be communicated in advance where required and will take effect in accordance with applicable law.

You will be able to cancel your subscription if you do not wish to continue at a new price.

15. Acceptable use

You agree not to use Claressence:

  • For unlawful purposes.
  • To attempt to gain unauthorised access to the service or another user's account.
  • To interfere with or disrupt the operation of the service.
  • To deliberately introduce malicious software, code or other harmful material.
  • To abuse, harass or threaten other people through features of the service.
  • To circumvent usage restrictions or security measures.

16. Intellectual property

The Claressence name, branding, software, design and underlying technology are owned by or licensed to the operator of the service.

You may use the service for its intended personal purpose in accordance with these Terms.

You must not copy, reproduce, reverse engineer, distribute or commercially exploit the service without permission.

17. Feedback

We may ask users to provide feedback about their experience with Claressence.

You agree that we may use feedback you voluntarily provide to improve the service and develop future versions of Claressence.

We will not publish your private conversations or identify you publicly as the source of feedback without appropriate permission.

18. Availability and changes

We may modify, suspend or discontinue parts of Claressence as the service develops.

We may also introduce new features or change existing features as we learn from how people use the service and from feedback we receive.

If a material change affects a paid subscription, we will deal with that change in accordance with applicable consumer law.

19. Disclaimer of warranties

To the extent permitted by law, we make no guarantee that the service will be uninterrupted, error-free, secure or suitable for your particular needs.

Nothing in this section affects rights or remedies that cannot lawfully be excluded or restricted.

20. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

Subject to that limitation, to the extent permitted by law, we will not be responsible for indirect or consequential loss arising from your use of the service.

Nothing in these Terms affects your statutory rights as a consumer.

21. Suspension or termination

You may stop using Claressence at any time.

We may suspend or terminate access to the service where reasonably necessary, including where we believe these Terms have been breached or where necessary to protect the service or its users.

Where we suspend, terminate or discontinue a paid service, any effect on subscription charges, access or refunds will be handled in accordance with applicable law and the circumstances of the suspension or termination.

22. Privacy

Your use of Claressence involves the processing of personal information and is also subject to our Privacy Notice.

The Privacy Notice explains how we process personal information, including information you choose to share in conversations and any special category information that may be processed in providing Claressence.

Where separate consent is required for particular processing, that consent will be requested separately and is not obtained merely by your acceptance of these Terms.

23. Changes to these Terms

We may update these Terms as Claressence develops or where changes are required for legal, regulatory, security or operational reasons.

Where appropriate, we will notify users of material changes and provide an updated effective date.

Changes will not affect statutory rights that cannot lawfully be excluded or restricted.

24. Governing law

These Terms are governed by the laws of England and Wales.

Any disputes arising in connection with these Terms will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights you may have under applicable law.
